TERMS AND CONDITIONS
1.1 This AT HOME WITH KING GIVEAWAY (Competition) is conducted by King Living Singapore Pte Ltd (UEN:201503463W) (KING).
1.2 KING conducts this Competition together with its participating retailers, partners including Qanvast Pte Ltd (Qanvast) and agencies associated with this Competition (Competition Partners, which includes Qanvast).
1.3 By submitting an entry to the Competition, you agree to be bound by these Terms and Conditions (Terms).
1.4 The Promotion commences at 12:00am SGT on Friday 6 October 2023 and ends at 11:59pm SGT on Sunday 15 October 2023 (Promotional Period).
1.5 To the extent of any inconsistency between these Terms and any other reference to the Competition, these Terms will prevail.
1.6 KING reserve the right to, at its discretion:
(a) amend these Terms and Conditions;
(b) cancel, suspend or restart the Competition for any reason; and/or
(c) disqualify any individual who has breached these Terms and Conditions or otherwise interfered with the proper conduct of the Competition.
1.7 These Terms are governed by the laws of Singapore.
2.1 The Competition is open to entry by any person who is:
(a) a lawful resident of Singapore; and
(b) 18 years of age or older (at the time of entry).
2.2 Employees (and their immediate families) of KING or its Competition Partners are not eligible to participate in this Competition.
2.3 Immediate family means the spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin of that employee.
2.4 KING reserves the right, at any time, to verify the validity of entries and any person who submits an entry (including that person’s identity, age and place of residence) and reserves the right to determine any person to be ineligible to participate in the Competition in its sole discretion.
3.1 An entry to the Competition will consist of a fully and correctly completed entry form (Entry). Entry forms are accessible at: [https://www.kingliving.com.sg/blog/at-home-with-king-giveaway].
3.2 A fully and correctly completed entry form will consist of:
(a) details of the person entering the Competition (Entrant) including their full name, email address and mobile telephone number; and
(b) an answer to the following contest question:
What is the most important furniture in your home, and why?
3.3 Entrants may be contacted by a representative of KING to provide additional information. Should an Entrant not provide additional information, the Entrant’s Entry may be rejected or not be selected as the winning Entry.
3.4 Entries will be accepted from 12:00AM (SGT) on 6 October 2023 to 11:59PM (SGT) on 15 October 2023. No Entry will be accepted after 11:59PM (SGT) on 1 October 2023.
3.5 Entries must be submitted through the designated KING website [insert link] prior to 11:59PM (SGT) on 15 October 2023.
3.6 Each person may only submit one Entry.
3.7 Any Entry that contains content that KING, in its sole discretion, considers to be offensive, obscene, crude or inappropriate in any way or that KING considers may infringe any intellectual property rights or other rights of any person, corporation or entity will not be accepted as an eligible entry into the competition. This includes but is not limited to any Entry which KING considers to be disparaging of it or any of its Competition Partners or any of it or their products and/or services or is otherwise not in keeping with the spirit of Competition.
4.1 The Competition is a game of skill. Winning Entries will be selected based on the creativity of the Entrant’s answer to the contest question.
4.2 KING will nominate a judging panel to judge each Entry based on the above criteria.
4.3 On 27 October 2023 the judging panel will announce the selection of the winner (Winner).
4.4 The winning entry notification period is 27 October to 31 October 2023 inclusive. During this period KING and Qanvast will publish the names of the Winner on their respective channels, and a representative of KING will make attempts to notify Winner of his/her winning entry using contact details provided by the Winner.
4.5 All decisions by KING (including the judging panel) are final and binding. No correspondence will be entered into.
5.1 The prize awarded to the Winner will be an SGD3,000 KING store credit.
(a) are not transferable or exchangeable;
(b) must be taken as offered and cannot be varied;
(c) cannot be taken as cash; and
(d) cannot be used or redeemed in conjunction with any other offer by KING.
5.3 The prize may be applied to the purchase of any KING product between the date on which the prize is announced or issued and 15 November 2023 (Redemption Period). Any unspent amount of the prize which is not used on or before the end of the Redemption Period will be forfeited.
5.4 If the value of the KING product purchased is less than the value of the prize, the purchase price of the product will be deducted, and the remaining balance can be redeemed on any other purchase of KING products during the Redemption Period. Purchase amounts that exceed the value of the prize will require an additional method of payment for the balance due.
5.5 If a prize is unavailable, KING reserves the right to substitute that Prize with a prize of equal value, in its sole discretion.
(a) a prize is not claimed on or before 15 November 2023;
(b) a Winner does not respond to KING within seven (7) days of notification of their winning Entry;
(c) a Winner does not claim their prize within time specified by KING in its notice to that Winner,
that Winner’s right to the prize is forfeited. KING reserves the right (in its sole and absolute discretion) to:
(i) select a new Winner and award the prize to that Entrant; or
(ii) not award the prize at all,
5.7 Any Winner found to have breached these Terms will not be entitled to any prize and must return any claimed prize within 30 days of a request to do so. KING will have the final decision on what to do with the prizes (including announcing a new Winner who will become entitled to that Prize).
5.8 KING accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought.
6 Intellectual Property
6.1 By submitting an Entry to the Competition, each Entrant warrants to KING that:
(a) that Entry is an original work and does not infringe the intellectual property rights of any third-party;
(b) that Entry does not contain any content that is obscene, offensive, defamatory, breaches any law or regulation or breaches any duty or obligation owed to a third party or infringes any rights of a third party;
(c) the Entrant is the sole legal and beneficial owner of all rights, title and interest in that Entry;
(d) the Entrant is fully entitled to sell, transfer and assign such rights, title and interest in that Entry without requiring the consent of any person;
6.2 If an Entrant is selected as a Winner:
(a) at the time the Entrant are notified by KING that he/she has been selected as a Winner, the Entrant will be deemed to have (and agrees to) assigned all of their rights, title and interest in and to their Entry to KING;
(b) that Entrant must do anything reasonably required by KING to perfect the assignment of their rights, title and interest in and to their Entry to KING and KING may withhold the award of the Prize if the Entrant fails to do so; and
(c) that Entrant consents to any act or omission by or on behalf of KING which infringes or may infringe any of the moral rights that they may have in that Entry pursuant to the Copyright Act 2021 (Singapore).
7 Promotional Materials
7.1 The Entrant agrees that, in the event they are a Winner:
(a) KING may reproduce, display, digitize, copy, distribute, publicly perform, modify (but solely for adaptation purposes), create derivative works of (in accordance with the terms hereof), and otherwise use and exploit the Entrant’s Entry in any and all manners, formats or media (whether now or hereafter devised) including on KING’s Website and any other online platform (including social media platforms);
(b) Qanvast may reproduce, display, digitize, copy, distribute, publicly perform, modify (but solely for adaptation purposes), create derivative works of (in accordance with the terms hereof), and otherwise use and exploit the Entrant’s Entry in any and all manners, formats or media (whether now or hereafter devised) including on Qanvast Website and any other online platform (including social media platforms);
(c) the Entrant will participate in all reasonable activities in relation to the Competition as requested by KING and sign any additional documents reasonably required by KING to give effect to this condition;
(d) the Entrant will, upon reasonable request by KING:
(i) permit representatives of KING to record the Entrant’s name, likeness, image, voice, sound effects, interview and performance in photographs and in films; and
(ii) permit representatives of KING to access the Entrant’s place of residence and to take photographs, film or otherwise record (in any medium whatsoever) of the Entrant and the furnishing present in the Entrant’s place of residence (including any KING furniture that may be acquired by the use of a prize awarded under this Competition)
(together, the Promotional Media).
7.2 The Entrant will not be entitled to any compensation or remuneration in respect of:
(a) the use of the Entrant’s Entry as contemplated by clause 7.1;
(b) the activities that the Entrant may be required to participate in under clause 7.1; or
(c) the Entrant complying with its obligations under clause 7.1; and
(d) the creation and use of the Promotion Media by King and/or its Competition Partners.
7.3 The Entrant:
(a) acknowledges that the Entrant will have no rights, title and interest in the Promotional Media and, to the extent that the Entrant may have such rights, title and interest, agrees to assign those rights, title and interest to KING for no consideration;
(b) gives full permission, without reservation or restriction, to KING and its Competition Partners, agents and assigns to edit, use, reproduce and publish the Promotional Media in any manner, formats and media (whether now or hereafter developed), throughout the world and in perpetuity, as determined by KING from time to time, for any purpose; and
(c) releases and forever discharge KING and its Competition Partners, their representatives, employees, agents and assigns from all claims, actions and liability relating to the use of the Promotional Media.
8.1 An Entrant must not enter into any arrangement with a third-party in relation to a Prize where a Prize is promoted or used as an incentive or reward for that Entrant and that third-party entering into any commercial or other arrangement.
8.2 Errors and omissions may be accepted at KING’s discretion. Failure by KING to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.3 Any attempt to cause malicious damage, interference with or to undermine:
(a) the business of KING (or any of Competition Partners);
(b) the normal functioning of, or the information on, the website(s) of KING or any of its Competition Partners; or
(c) the security, fairness, integrity or proper conduct of this Competition,
will constitute a breach of these Terms.
8.4 KING reserves its rights to recover damages or other compensation from any person who breaches these Terms.
8.5 Except for liability that cannot be excluded by law, KING accepts no liability for any event, circumstances, loss or expense arising from the Competition.
8.6 To the maximum extent permitted by law, each Entrant indemnifies, and must defend and hold harmless, KING, its Competition Partners and each of their employees, servants, agents and contractors, from and against all Losses arising from:
(a) a breach by the Entrant of any of these Terms;
(b) any third party claim arising directly or indirectly from a breach by the Entrant of any of these Terms;
(c) any negligent, wilful or otherwise wrongful act or omission of the Entrant;
(d) any fraudulent or dishonest acts or omissions by the Entrant;
(e) any breach by the Entrant of any applicable Laws;
(f) any claim by any third party (including individuals, legal entities and governmental departments or agencies) arising directly or indirectly as a result of the Entrant entering the Competition; and
(g) the death of, or personal injury to, any person or any damage to, or loss or destruction of, any real or tangible personal property, to the extent caused by any act or omission of the Entrant.
9.1 KING collects Personal Data as defined by Personal Data Protection Act 2012 (Singapore) (PDPA) about an Entrant to include the Entrant in the Competition, award the prizes (where appropriate) and use the information to assist in marketing of KING and Qanvast’s products and services. If the Personal Information requested by KING is not provided, the Entrant will not be eligible to participate in the Competition.
9.2 By entering into this Promotion, each Entrant consents to,
(a) to the collection, use and disclosure of the Entrant’s Personal Information by KING and by Qanvast to:
(i) provide the relevant prize to the Entrant if the Entrant is a Winner; and
(ii) contact the Entrant in the future with information about KING and Qanvast, including special offers, market research or to provide the Entrant with marketing materials via any medium,
(b) the collection and use, by KING, of the Entrant's name, locality, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media worldwide at any time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Competition (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by KING; and
(c) the disclosure by KING to, and the use by, Qanvast of the Entrant's name, locality, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media worldwide at any time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Competition (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by Qanvast.
9.3 Personal information is only available for review by designated individuals in compliance to the PDPA. No individually identifiable information about you will be shared with any third party.
